SNAP Terms and Conditions

By selecting the “[SNAP Rewards]” user setting and attempting to enroll in the SNAP Rewards program (the “Program”) you are consenting to these Terms and Conditions (the “Terms”). Please read these Terms carefully before attempting to enroll in the Program. These Terms contain a mandatory arbitration clause and a class action waiver. Ibotta’s Privacy Policy and Terms of Use also apply to your enrollment in the Program. We may amend these Terms, and modify or cancel the Program or any of its features without notice. Any such modifications will be effective immediately upon posting the updated version of these Terms. By remaining enrolled in the Program, you agree to these modifications. Capitalized words and phrases that are not defined in these Terms will have the meaning given to them in Ibotta’s Terms of Use or Privacy Policy.

The Ibotta SNAP Rewards program

As further described in our Terms of Use, Ibotta provides its users with Rewards when they complete purchases of Offers. If you enroll in the Program, then Ibotta may provide you with unique Offers that are only presented to Program participants. These Offers may, for example, provide you with additional or greater Rewards, or be for items that are not included in Offers shown to Ibotta users who are not Program participants. In no event will Program participants be provided with fewer Offers or less opportunities to earn Rewards than users who do not participate in the Program.

How to enroll in and withdraw from the Program

You must meet the following requirements before being eligible to enroll in the program. 

To submit a “Qualifying Receipt,” you must upload a valid shopping receipt to Ibotta through the Ibotta mobile application that evidences your use of an Electronic Benefits Transfer (commonly referred to as “EBT”) payment card. Purchase information submitted to Ibotta through your linked retailer loyalty accounts will not constitute a Qualifying Receipt. 

Receipts that are submitted for purchases completed at the following retailers will not count as Qualifying Receipts:

You may withdraw from the Program at any time by deselecting the SNAP Rewards user setting in the preferences section of your Ibotta user profile and saving your updated preferences. You acknowledge that you may continue to receive SNAP Rewards Offers for a reasonable amount of time after you withdraw from the Program.

You acknowledge and agree that Ibotta, in its sole discretion, reserves the right to allow or not allow You or any other user to enroll in the Program.

Continued Qualification for the Program Required

Ibotta may periodically review your account information to determine whether you still qualify for the Program. You acknowledge and agree that Ibotta may withdraw you or any user from the Program (a) who has not submitted a Qualifying Receipt during the preceding thirty (30) days, (b) who no longer meets the qualification requirements to participate in the Program, as determined by Ibotta, or (c) for any other reason. Prior to withdrawing you from the Program, Ibotta may attempt to contact you (via email or another communication method to which you have consented) to encourage you to submit a Qualifying Receipt or complete a brief survey which will enable Ibotta to determine if you still qualify for the Program.

Dispute Resolution

Please contact our Care team to resolve any disputes that may arise. If we cannot resolve your concern and you believe you have a claim against us, you agree that the claim shall be resolved by binding arbitration on an individual basis only. 

Arbitration Agreement

Arbitration replaces the right to go to court, including the right to have a jury, to engage in discovery (except as may be provided in the arbitration rules), and to participate in a class action or similar proceeding. In arbitration, a dispute is resolved by an arbitrator instead of a judge or jury. Arbitration procedures are simpler and more limited than court procedures. Any arbitration will be limited to addressing your dispute individually and will not be part of a classwide or consolidated arbitration proceeding. All issues related to the arbitration, including the arbitrability of the claim, shall be resolved by the arbitrator. If you cannot afford to initiate an arbitration, Ibotta will advance all arbitration association filing costs and fees, which shall be deducted from any final award you receive if you prevail but will not be recoverable by us if we prevail. Each of us shall bear our own attorneys fees. 

Class Action Waiver

NO CLASS ACTIONS. TO THE EXTENT PERMITTED BY LAW, YOU AND IBOTTA AGREE THAT EACH MAY BRING CLAIMS AGAINST THE OTHER ONLY IN YOUR OR ITS INDIVIDUAL CAPACITY, AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS OR REPRESENTATIVE PROCEEDING.

Governing Law and Venue

These Terms and Conditions shall be governed by the laws of the State of Colorado as they apply to agreements entered into and to be performed entirely within Colorado by Colorado residents, and without regard to conflict of law principles. An arbitrator shall apply the substantive laws of Colorado. To the extent that any lawsuit or court proceeding is permitted hereunder, you and Ibotta agree to submit to the personal and exclusive jurisdiction of the state courts and federal courts located within Denver, Colorado for the purpose of litigating all such claims or disputes.

IF YOU ARE A RECIPIENT OF BENEFITS UNDER ANY SUCH PROGRAM, THEN YOU ARE SOLELY RESPONSIBLE FOR ENSURING THAT YOU COMPLY WITH ALL TERMS OR RESTRICTIONS APPLICABLE TO SUCH PROGRAM.
